Fair Labor Standards Act (FLSA)

FLSA Overview

The Fair Labor Standards Act (FLSA) is a federal law that establishes the standards for:

  • Wages
  • Overtime pay
  • Child labor
  • Record-keeping

The U.S. Department of Labor’s (DOL) Wage and Hour Division (WHD) enforces the FLSA. All employees at NC State are impacted by the FLSA. This includes SHRA, EHRA faculty and non-faculty, post-docs, graduate students, student workers, and temporary employees. Employees in all of these groups have a FLSA status as either ‘exempt’ or ‘non-exempt’.
